1. Acceptance of These Terms

By downloading, installing, accessing, or using the Say It Fluently app ("the app", "the Service"), you agree to be bound by these Terms of Use ("these Terms"). If you do not agree to these Terms, do not use the app.

If you are using the app on behalf of a minor, you represent and warrant that you are the parent or legal guardian of that minor and accept these Terms on their behalf.

2. Description of the Service

Say It Fluently is a CEFR-based language learning application that provides spaced repetition study tools, adaptive quizzes, vocabulary training, and structured exam preparation. The app currently supports Indonesian and Norwegian, with additional languages planned.

The Service is provided on mobile platforms (Android and iOS) and on the web. Some features may be platform-specific or require an internet connection.

3. Accounts & Registration

To access the full features of the app, you must create an account. You can register using an email address and password, or by signing in with a supported OAuth provider (Google, Apple, Microsoft, or Facebook).

4. Subscriptions & Billing

The app is currently available free of charge. We may introduce optional premium subscriptions in the future. This section describes the terms that will apply if and when subscriptions become available.

We use a third-party service (RevenueCat) to manage subscription entitlements across platforms. RevenueCat processes subscription verification data on our behalf. See the RevenueCat Privacy Policy for more information.

5. Cancellation & Refunds

5.1 How to Cancel

You can cancel your subscription at any time through the platform where you purchased it:

When you cancel, your subscription remains active until the end of the current billing period. You will continue to have access to premium features until that date. No further charges will be made after the current period ends.

Violation of these rules may result in account suspension or termination, and we reserve the right to take legal action for serious violations.

9. Intellectual Property

The app, including its design, code, vocabulary databases, study plans, UI elements, logos, and branding, is owned by Say It Fluently and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial language learning purposes.

You may not copy, modify, distribute, or create derivative works from the app's content without our prior written consent, except as permitted by applicable law.

10. User-Generated Content

The app does not currently allow users to publish public content (such as posts or comments). User-generated data consists of your learning progress, achievements, and social connections (friendships, friend requests).

Your username is visible to other users on leaderboards and in friend lists. You are responsible for choosing a username that is not offensive, misleading, or infringing on others' rights. We reserve the right to change or remove usernames that violate this policy.

11. Termination

You may stop using the app and delete your account at any time. See our Privacy Policy for instructions on how to delete your account and data.

We reserve the right to suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if we believe your account activity poses a risk to the Service or other users. We may also discontinue the Service or any part of it with reasonable notice.

Upon termination, all licenses granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will remain in effect.

12. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that:

13. Limitation of Liability

To the maximum extent permitted by applicable law, Say It Fluently and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the app.

Our total aggregate liability for any claim arising out of these Terms shall not exceed the amount you have paid us through the app in the twelve (12) months preceding the claim, or fifty US dollars ($50) if you have not made any purchases.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Changes to the Service & Content

We are continuously improving the app. As such, the Service and its content may change over time. Specifically:

Educational content is subject to refinement. CEFR level assignments, vocabulary classifications, and question difficulty are based on our methodology and may be adjusted as we improve our content pipeline. Your progress data will not be lost due to content changes, but specific items may be reclassified or removed.

15. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date at the top of this page. For material changes (such as changes to subscription terms, liability, or acceptable use), we will notify you through the app or via email before the changes take effect.

Your continued use of the app after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the app and delete your account.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the app shall be resolved in the courts of Norway, unless mandatory consumer protection laws in your jurisdiction require otherwise.

If you are a consumer in the European Union, you retain the rights granted to you under the mandatory provisions of EU consumer protection law, including the right to bring proceedings in your country of residence.
